Terms of Service (AGB)

1. Scope of Application

These General Terms and Conditions (AGB) apply to all orders placed through the online store of Findoak GmbH (hereinafter "Findoak", "we", or "us"). By placing an order, the customer expressly agrees to these AGB. Deliveries are made exclusively within Switzerland and the Principality of Liechtenstein.

2. Contract Conclusion & Pre-Orders

The presentation of products in the online store does not constitute a legally binding offer. A binding contract is only concluded when Findoak sends an explicit "Order Confirmation" or "Shipping Confirmation" via email.

Pre-Orders and Deposits: For vehicles marked as "Pre-Order", a flat deposit of CHF 500 is required to secure your reservation. This CHF 500 deposit is 100% fully refundable at any time, for any reason, prior to the final shipping preparation. When your vehicle is ready for dispatch, Findoak will send a final payment request for the remaining balance. If the customer chooses to cancel before paying the remaining balance, the CHF 500 deposit will be refunded in full to the original payment method, and the vehicle will be allocated to the next customer on the waitlist. Once the final payment is made and the vehicle is handed over for delivery, the sale is final.

3. Prices and Payment

All prices are quoted in Swiss Francs (CHF) and include the statutory Swiss Value Added Tax (VAT) of 8.1%, as well as any applicable advance recycling fees (vRG). Findoak reserves the right to change prices at any time; however, the price at the time of the order applies. The remaining balance for pre-ordered vehicles must be paid in full before delivery or physical handover.

4. Delivery and Transfer of Risk

Deliveries are made to the address provided by the customer. The delivery times stated in the store are estimates. In the event of delivery delays resulting from global supply chain logistics, the customer will be informed immediately. Under Swiss law (Art. 185 OR), benefit and risk pass to the customer upon handover of the goods to the transport company or upon physical handover during local pickup at our facility in Uzwil.

5. Return Policy (No Right of Withdrawal)

In accordance with Swiss law, there is no general statutory right of withdrawal or return for online purchases once the goods have been dispatched. Due to the nature and depreciation of motor vehicles, all sales are considered final upon delivery or pickup. Returns or exchanges are only accepted in exceptional, mutually agreed-upon cases, exclusively for vehicles with exactly 0 kilometers driven, in original packaging, and without any signs of use. Any approved return shipping costs are the sole responsibility of the buyer.

6. Warranty (Gewährleistung)

Findoak grants the statutory warranty period of 24 months from the date of delivery for material and manufacturing defects. Findoak reserves the right to repair the defect, supply a replacement part, or provide a replacement vehicle at its discretion. The warranty explicitly excludes:

  • Normal wear and tear (including but not limited to tires, brake pads, chains, sprockets, grips, and the 1 valve on both tires).
  • Natural degradation of the lithium-ion battery capacity over time.
  • Damage caused by improper maintenance, use of pressure washers, or accidents.
  • Any vehicle that has been mechanically or electronically modified (e.g., tuning, removing speed limiters, or cutting the restrictor wire).

7. Liability and Road Legality

Findoak assumes no liability for damages resulting from the improper use of the vehicles. The customer acknowledges that "Off-Road" models (e.g., Light Bee X, Ultra Bee R) do not possess road homologation and may not be operated on public roads or cycle paths in Switzerland. Modifying homologated (L1e/L3e) models to increase speed invalidates the vehicle's road legality and insurance coverage. Findoak is not liable for fines, confiscations, or damages resulting from illegal operation.

8. Applicable Law and Jurisdiction

These AGB and all legal relations between Findoak and the customer are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from this contract is the registered seat of Findoak (Uzwil, Canton of St. Gallen), unless mandatory statutory provisions dictate otherwise.
